LICENSE AGREEMENT - Effective April 8th, 2016 IMPORTANT - READ CAREFULLY This license statement and limited warranty constitutes a legal agreement ("License Agreement") between you ("Licensee", either as an individual or a single entity) and Math Teacher's Resource, Inc. ("Licensor") who is the sole worldwide publisher of the Software product Basic Trig Functions. The Web Site referred to in this agreement is http://www.mathteachersresource.com. The Software referred to in this agreement is Basic Trig Functions. The Licensor reserves the right to license the same Software to other individuals or entities under another license agreement. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, THE LICENSEE AGREES TO BE BOUNDED BY All OF THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT. License Terms: Licenses are perpetual and free of charge for users who download and install the Software from the Web Site. The license is valid for the Software version offered at the time of Software download. The Software may be installed on individual or networked machines provided that the Software is used for educational purposes only, either by individuals (e.g. students, teachers, tutors) or by institutions or groups regularly engaged in educational activities (e.g. schools, tutoring organizations, math clubs). The Software may not be used to generate information or content that is sold, either by the Licensee or another party. Example: The Software may not be used to create graphic images to be included in printed or video media for sale to another party. License Revocation: The Licensor reserves the right to revoke a license without prior notice if the Licensee violates any term of this License Agreement. If at any time the Licensee fails to comply with all terms and conditions of the License Agreement, the Licensee must promptly delete the Software from affected computers and storage devices. Resale and Distribution: The Licensee is strictly prohibited from selling, distributing, or otherwise transmitting the Software or its installation program to another party. Donations: The Licensee has the option to provide a monetary donation to the Licensor for use of the Software, but the donation is strictly voluntary. At the Web Site, the Licensor will provide an easy way to make a donation if the Licensee so chooses. The Licensor has no obligation to refund any donations. Technical Support: Users can obtain technical support by sending an e-mail to info@mathteachersresource.com or by completing the contact form found on the Web Site. Technical support is limited only to the reporting of Software errors and inquiries regarding Software functionality. Responses will not be provided to inquiries regarding mathematical concepts presented in the Software. While the Software has been constructed and tested with great care, it is not possible to warrant that the Software is error free. If errors are found in the Software, the Licensor will release an update of the Software which no longer contains the errors and will notify Licensees of the update by e-mail if the Licensee provided a valid email address to the Licensor. Licensees can then go to the Web Site and download these error corrected updates. It is the responsibility of Licensees to maintain their Software version up to date. The Licensor will only provide technical support for the Software version that is currently offered on the Web Site. Users can determine if their Software version is current by selecting the Help/About Menu command in the main window of the Software and then comparing it to the Software version offered on the Web Site. Liability and Damages: The Software is provided “as is”. While the Software has been constructed and tested with great care, it is not possible to warrant that the Software is error free. To the maximum extent permitted by applicable law, the Licensor, the Licensor's affiliates, and Licensees shall not be liable for any consequential, special, incidental, or indirect damages of any kind arising out of the delivery, performance, or use of the Software under the terms of the License Agreement. The Software is neither designed nor intended to be used in any activity that could cause personal injury, death, damages, or loss. Changes to Policy: The Licensor reserves the right to change the terms of this License Agreement for future transactions at the Licensor's sole discretion without prior notice. Software Integrity Statement: The Licensee or any other party must not attempt to reverse compile, modify, translate or disassemble the Software in whole or in part. The Licensee or any other party must not run the Software under a debugger or similar tool that allows inspection of the inner workings of the Software.
